DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND LIENS WEXFORD MEWS SUBDIVISION NO. 1

This Declaration made this __16th___ day of ____March_______, 1990, by WEXFORD MEWS DEVELOPMENT CORPORATION, a Michigan corporation, whose address is 32270 Telegraph Road, Suite 200, Birmingham, Michigan 48010 (hereinafter referred to as "Declarant").
WITNESSETH:
WHEREAS, Declarant is the owner of certain real property known as Wexford Mews Subdivision No. 1 located in the City of Wixom, Oakland County, State of Michigan, and more particularly described in Exhibit A attached hereto, and incorporated herein by reference (hereinafter the "Subdivision"); and
WHEREAS, the Subdivision has been platted in accordance with a plat recorded in Liber_____ at Page____, of Plats, Oakland County Records; and
WHEREAS, Declarant desires hereby to impose upon the Subdivision (but not any property outside of the Subdivision, whether or not owned by Declarant) covenants, conditions and restrictions in order to insure the most beneficial development of the Subdivision as a single family residential area, to prevent any use thereof which might tend to diminish its valuable or pleasurable enjoyment, and to assure the harmony, attractiveness and utility thereof, to provide for Lot Owners in the Subdivision to bear certain expenses, and to impose other rights and obligations as set forth below; and
WHEREAS, Declarant will cause a non-profit corporation to be known as the Wexford Mews Subdivision Homowners Association to be created under the laws of the State of Michigan for the purpose of exercising the powers and functions herein described; and
WHEREAS, the Declarant has entered into an Agreement for Subdivision Open Space Plan with the City of Wixom which has been recorded in Liber______ at Page _____, Oakland County Records, and which provides for the maintenance of the Common Areas of the Subdivision by the City of Wixom in the event that the Wexford Mews Subdivision by the City of Wixom in the event that the Wexford Mews Subdivision Homeowners Association fails to maintain the Common Areas of the Subdivision in reasonable order; and
WHEREAS, Declarant is also the owner of certain real property abutting the Subdivision to the North which Declarant desires to develop into a single family residential subdivision to be known as Wexford Mews Subdivision No. 2 (hereinafter the "Proposed Subdivision"); and
WHEREAS, Declarant also desires, in the event the Proposed Subdivision is developed and platted, to impose certain similar covenants, conditions and restrictions on the property located within the Proposed Subdivision and provide for the payment of certain expenses by the owners of lots in the Proposed Subdivision pursuant to Article XIII hereof; and
